Enforcing International Construction Arbitrations and Beyond

Complicated construction arbitration throws up challenges of its own, all the more when it involves State entities; but beyond the dispute, in this session we look at what happens when the other side doesn't pay and you face obstacles to enforcement in the local courts. Can the High Court in London and public international remedies come to the rescue?   

Using a case-study, we look at: 

  • The life-cycle of a construction project in a foreign jurisdiction commissioned by a government entity and the typical disputes that arise, resulting in international arbitration; 
  • The tactics that may be employed during and after an arbitration to avoid honouring an Award in jurisdictions where one party has local influence; 
  • The investigations and steps that may be taken in the High Court of London to apply pressure and encourage settlement; and 
  • The public international legal remedies that may result in recovery.
