The Panel will focus on when a party should start considering enforcement risk and the tools available to protect clients from an award that has no value due to an inability to enforce. With a panel of investigators, lawyers and inhouse counsel, the panel will take a nose to tail approach in a practical case study looking at everything from BIT protection, early asset investigation and contractual protections through to the steps to take before filing an arbitration and how to monitor assets during an arbitration. We will seek to provide advice on steps to take to protect not only the legal enforceability of the award but also the practical enforceability in tracing assets.
